Terms & Conditions

These terms cover both families and candidates working with The Park Collective (TPC). Please read the section that applies to you, alongside the general terms and safeguarding standards below.

For Families

TPC introduces families to candidates who have been vetted, referenced, and interviewed by us. We take real care in finding the right match for your family, but the final decision to engage a candidate always rests with you. Our fees are confirmed with you individually before any placement begins.

Refunds

If a placement doesn't work out, a partial refund is available on the following sliding scale, calculated from the candidate's start date:

  • Within 4 weeks: 50% refund

  • Weeks 5 to 8: 25% refund

  • After week 8: no refund

Refunds apply only where the candidate leaves the role or the placement is ended by either party, and don't apply where a family chooses not to proceed with a candidate before a placement has begun.

For Candidates

To register with us, we ask that you provide:

  • A current, accurate CV setting out your childcare experience, qualifications, and employment history

  • A valid Paediatric First Aid certificate, issued within the last three years

  • A current Enhanced DBS certificate (if you're not already on the Update Service, we may ask you to complete a new check)

  • At least two recent references from previous childcare roles or employing families, which we will contact directly as part of vetting

  • Proof of your right to work in the UK, or in the relevant country if the placement is overseas

You confirm that everything you tell us is true, accurate, and complete. If we find that information you've given us is false or misleading, we may remove you from our candidate list and end your application with us. We may also remove your profile if application requirements are no longer met, we receive a report of unprofessional conduct, or we reasonably believe removal is necessary to protect a family or child.

It's your responsibility to let us know about the renewal or expiry of your DBS certificate or first aid qualification, any change to your right to work status, and any new qualifications, roles, or experience worth adding to your profile.

By registering, you agree to hear from us by email about relevant roles and service updates. With your consent, this may also include newsletters. You can opt out of anything beyond essential role updates at any time by contacting us at hello@theparkcollective.co.uk.

Our Role

TPC acts solely as an introductory agency. Once a placement is confirmed, the employment contract is between the family and the nanny or maternity nurse directly, not with TPC. TPC is not responsible for salary, tax, National Insurance, or any other employment obligations arising from the placement once it has begun. ‍

Safeguarding and Safer Recruitment

The wellbeing of the children our candidates care for sits at the centre of how TPC operates. Before we put a candidate forward to a family, we require the vetting standards listed above (Enhanced DBS, current Paediatric First Aid, references we take up ourselves, right to work, and a full CV with any employment gaps reviewed).

An introduction from TPC means a candidate has met these standards. Families remain the employer of their nanny and are responsible for the day-to-day working relationship, and we remain on hand to support you throughout the placement. Candidates agree to act at all times in the best interests of the children in their care, and to report any safeguarding concern immediately to the appropriate authority.

Where a child is at immediate risk, please contact the police on 999. You can also raise concerns with your local authority children's services, or the NSPCC helpline on 0808 800 5000.

Non-Discrimination and Equal Opportunities

TPC is committed to fair and equal treatment of every candidate and every family we work with. We do not discriminate on the basis of age, disability, gender reassignment, marriage or civil partnership, pregnancy or maternity, race, religion or belief, sex, or sexual orientation, in line with the Equality Act 2010. Every candidate is assessed on their experience, qualifications, and suitability for a role, nothing else. We do not accept placement instructions from families that conflict with this policy, and we reserve the right to decline any instruction that does.

Your Data

Your personal data is processed in line with our Privacy Policy. We will not share a candidate's details with a family until we've spoken with them about the opportunity.

Complaints

We take every complaint seriously and aim to deal with it properly and promptly.

  1. Email us at hello@theparkcollective.co.uk with the details of your complaint, including relevant dates and any supporting information

  2. We'll acknowledge it within 3 business days

  3. We aim to give you a full response within 14 business days, and will keep you updated if it takes longer

  4. If you're not satisfied with our response, you're welcome to raise the matter further with Citizens Advice

Every complaint is handled in confidence, and raising one will never affect your standing with TPC.

Our Liability

We take real care in vetting and matching candidates, but we can't guarantee how a placement will work out once it begins, that depends on the working relationship between you and the family or candidate. TPC is not liable for any loss, cost, or damage arising from a placement or introduction, except where the law doesn't allow us to limit our liability, such as for death or personal injury caused by our own negligence.

Late Payment

If an invoice isn't paid by its due date, we reserve the right to charge interest on the overdue amount, in line with the Late Payment of Commercial Debts (Interest) Act 1998.

Confidentiality

We treat all information shared with us, about your family or your application, with discretion. Please see our Privacy Policy for full detail on how we handle personal data.

Governing Law

These terms are governed by and interpreted in accordance with the laws of England and Wales.

Entire Agreement

These terms, together with our Privacy Policy, make up the whole agreement between you and TPC. Any changes to these terms only count if agreed with us in writing.

If Part of These Terms Doesn't Apply

If any part of these terms is ever found unenforceable, the rest will continue to apply as normal.

Changes to These Terms

We may update these terms from time to time. The version in place at the time you instruct or register with TPC will apply.
